I. PURPOSE OF THE PRIVACY POLICY

This Privacy Policy (“Privacy Policy”) describes the usage of personal data collected by us. The terms “Skyworker”, “we”, “us”, and “our” refer to Skyworker Inc., with an address at: 73 Boatworks Drive, Bayonne, NJ 07002. Our contact email is: info@skyworker.io.

Please read the following Privacy Policy so that you understand your rights in relation to your personal data, and how your personal data may be collected, stored, used, shared, and processed.

In this Privacy Policy “Services” means our Website, any feature provided by us via the Website, or any local application (mobile desktop or otherwise).

References in this Privacy Policy to your “personal data” describes the information that can be associated with a specific person (the “User”) and can be used to identify that person (including information about your activities, such as information about your use of our Services, when directly linked to personally identifiable information, including automatically collected).

By continuing using our Services, including but not limited to browsing the Website, and subscription to our newsletter, you acknowledge that you have read and understood the information described in this Privacy Policy that is an integrated part of our Terms of Use. If you do not agree with this Privacy Policy in general or any part of it, you should not use the Services.

II. COLLECTION, PROCESSING, AND USE OF YOUR PERSONAL DATA

When you use the Website (including the mobile version), We may collect the information sent to us by your computer, mobile phone, or other access devices. We may also collect your personal details from third parties, such as LinkedIn, if you allow us to. Based on two main types of Users on our Website:

  • ‘Specialist’ is a user registered on the Website to search for IT jobs.
  • ‘Company user’ is a representative of a tech company registered on the Website to search for Specialists (“Company”).

We collect the following information about Specialists:

  • name and surname;
  • e-mail address;
  • password;
  • types of information: country, city, preferable work type, profile type, job search status, desired salary;
  • preferable communication channels;
  • information about professional experience, including current and previous workplaces, skills, technologies, languages, resume, portfolio, additional info etc.;
  • other personal details that you may voluntarily add to your account; and
  • activities on the website, including analytics, matches related to Specialists, interaction with the matched vacancies, chats with Companies, profile strength, and whether the Specialist has been hired for a job.

We collect the following information about Companies and Company users:

  • name and surname;
  • e-mail address;
  • password;
  • Company summary (name, location, social networks, professional description, office photos, benefits, office locations, etc);
  • vacancy summary (vacancy description, skills, responsibilities, requirements, description of the Company, projects or products, work conditions, salary budget); and
  • activities on the website, including analytics, matches related to Companies, interaction and chats with Specialists, and the vacancy status and strength.

Job salary expectations of the Specialist are not publicly displayed on the Website. Salary budget of Companies vacancies can be made public at the choice of the Company. We collect and use all this information from you for various purposes and only when we have a legal basis for it. In particular, we may use your personal data to:

  • Administer our Website and provide you with our Services. The applied legal basis for this is the performance of the contract (Terms of Use) between you and us (GDPR Art. 6.1.b);
  • Personalize our Website for you. The applied legal basis for this is our legitimate interests (GDPR Art. 6.1.f);
  • Improve our Services and understand how you use our Website (GDPR Art. 6.1.f);
  • Send you technical notices, administrative messages, and provide you with customer support (GDPR Art. 6.1.b);
  • Contact you on behalf of a Company user for troubleshooting purposes (GDPR Art. 6.1.f);
  • Based on your consent, send you marketing messages and communicate with you about our Service offers, promotions, events, and other news and information we think will be of interest to you (GDPR Art. 6.1.a);
  • Monitor and analyze trends, usage, and activities in connection with our Website and Services based on your consent or our legitimate interests (GDPR Art. 6.1.a and GDPR Art. 6.1.f);
  • Provide third parties with statistical information about our Users (GDPR Art. 6.1.a);
  • Keep internal records in order to prevent fraud and ensure the appropriate protection of your personal data (GDPR Art. 6.1.f);
  • Process requests to help you exercise your rights in relation to your personal data and comply with other applicable legislation (GDPR Art. 6.1.c).

III. ANALYTICS, SOCIAL COMMUNICATION, AND OTHER SERVICES

We use analytics services to collect details of the Website use, including, but not limited to traffic data, location data, length of visit, other communication data, IP address, and device information (such as hardware model, operating system version, unique device identifiers). In aggregated form, this information allows us to analyze the popularity and usability of the Website.

V. HOW WE MIGHT SHARE YOUR PERSONAL DATA

We may share your personal data with:

  • Our vendors and other third parties engaged by us to help us provide Services to you. We use third-party services for data storage (AWS), document storage (Google Drive) sending email notifications, newsletters (Mailgun, MailerLite), and announcements, as well as to manage our relationships with Users (CRM systems like Hubspot). We also use third-party authentication tools to allow you to set up your User account faster. These third parties may only use information about Users to perform Services on the Skyworker’s behalf. They are not allowed to use it for their own purposes.
  • companies that we plan to merge with or be acquired by (should such a combination occur, we will notify you and will require that the newly combined entity follow these terms with respect to your personal data);
  • law enforcement, government officials, or other third parties when we are compelled to do so by a subpoena, court order, or similar legal procedure; or we believe in good faith that the disclosure of personal data is necessary to prevent physical harm or financial loss, to report suspected illegal activity or to investigate violations of any of our policies.

We will not provide your personal data to any other Users or third parties other than those described in this Policy without notifying you first.

Additionally, we undertake not to sell or rent your personal data to third parties, other than as described in this Policy, and without notifying you first.

VI. HOW WE KEEP YOUR PERSONAL DATA SAFE

We place great importance on the security of the personal data associated with our Users. We maintain administrative, technical, and physical safeguards designed to protect the personal data we have about you against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure, or use. We make reasonable efforts to ensure a level of security appropriate to the risk of the processing, taking into account the costs of implementation and the nature of the processing of personal data.

Immediate access to some amount of the data is only allowed to our authorized employees involved in maintaining the Services. Such employees keep strict confidentiality and prevent unauthorized third-party access to personal information.

VII. HOW WE TRANSFER YOUR PERSONAL DATA

We store your personal data on the servers of the cloud provider inside the European Union (currently in Ireland). However, we may also transfer Users’ information locally across different jurisdictions to perform processing activities. In this case, we ensure the appropriate safeguards are in place to protect the information, such as Standard Contractual Clauses.

VIII. HOW LONG WE KEEP YOUR PERSONAL DATA

We keep your personal data for only as long as we need to. How long we need your personal data depends on what we are using it for, as set out in this privacy policy. For example, we may need to use it to answer your queries about our Service and as a result, may keep personal data while you are still using our Services. If we no longer need your data, we will delete it or make it anonymous by removing all details that identify you.

Generally, your data will be removed from our systems once you decide to delete your account in the settings.

IX. YOUR RIGHTS

If you are based in the EEA region, you have certain rights regarding your personal data under applicable privacy laws. Please note that such rights are not absolute and under certain circumstances, we may need to refuse to satisfy your request.

If you are a User acting on behalf of our client (i.e. Company), you should communicate your wish to exercise your rights to your Company.

In particular, you have the right to:

  • Withdraw your consent at any time. You have the right to withdraw the consent if you previously gave the consent to the processing, for example, for marketing emails and cookies;
  • Object to the processing of your personal data. If we process your personal data in our legitimate interests, e.g., for direct marketing emails or for our marketing research purposes, you can object to it. We will consider your request and, if there are no legal grounds to refuse it (e.g., public interest), stop the processing for such purposes;
  • Access your personal data. You have the right to know if the Skyworker process your personal data, get full knowledge on processing, and obtain a copy of your personal data in the Skyworker’s possession;
  • Verify your personal data and seek rectification. If you find that we process inaccurate (e.g., mistakes in contact details) or out-of-date information, you can verify the accuracy of your personal data and/or ask for it to be updated or corrected;
  • Restrict the processing of your personal data. When you contest the accuracy of your personal data, believe we process it unlawfully, or want to object to the processing, you have the right to temporarily stop the processing of your personal data to check if the processing was consistent. In this case, we will not process the information for any purpose other than storing it or for the legal compliance purposes until the circumstances of restriction cease to exist;
  • Ask us to delete/destroy/otherwise remove the information about you. If we are not obliged to keep the data for legal purposes, we will remove your personal data upon your request.
    Please note, that the deletion of your personal data may affect your experience on our Website or lead to close of relationships between you and us if the information was strictly necessary for the provision of Services; and
  • Have your personal data transferred to another organization. Where we process your personal data on the legal basis of consent you provided us or on the necessity to perform a contract, we can make, at your request, your data available to you or to an organization of your choosing.

Your request can usually be processed within 72 hours from the moment we receive it. However, due to technical reasons delays are possible, and in such cases, we shall process the respective request within a reasonable term.

X. UPDATES OR AMENDMENTS TO PRIVACY POLICY

We may make changes to this Privacy Policy. If we make any changes to the Privacy Policy they will be posted on this page, notified to our Users, and we will change the “Last Updated” date below. Should the changes affect processing activities performed on the basis of the User’s consent, we will collect new consent from you, where required.

This Privacy Policy was updated on December 5th, 2022, and applies to all relationships on the Website on or after that date.
